USPTO General Counsel Addresses Guests at 56th Annual IP ...

The Center for Intellectual Property Law at The John Marshall Law School welcomed more than 200 attorneys from around the country for the 56th Annual Intellectual Property Law Conference, ?Hot Topics and Current Developments in Patent, Trademark, Copyright and Trade Secrets Laws? on Feb. 24, 2012.

Keynote speaker for the event was Bernard Knight, general counsel for the United States Patent and Trademark Office, who addressed the new America Invents Act, considered one of the most important pieces of legislation affecting patent law in the last 50 years.

U. S. patent laws will change so that by the spring of 2013, there will be new issues and new proceedings for patent practitioners, inventors and businesses to consider. Included in the changes is a move to a first-to-file system rather than the current first-to-invent system. This will put the U.S. in closer alignment with its global partners in determining priority of invention based on the earliest date a patent application was filed with a patent office. There is a limited one-year grace period related to public disclosures made by the inventor.

In addition, the America Invents Act will be replacing the long-standing procedure to prove a prior invention, i.e., interference proceedings, with ?derivation proceedings? to determine whether an inventor of a first-filed patent application derived the claimed subject matter without authorization from an inventor named in a later-filed application.

Guest presenters at the Center for Intellectual Property Law?s 56th Annual IP Law Conference were (from left) Kevin C. May of Neal, Gerber & Eisenberg; R. Mark Halligan of Nixon Peabody LLP; William T. McGrath, acting director of the Center; William Frankel of Brinks, Hofer, Gilson & Lione; Mark V.B. Partridge of IP Law; and Chief Judge James F. US regulators probe Google privacy breach: report

The U.S. Federal Trade Commission is examining whether Google deceived consumers by planting so-called Internet cookies in Apple's Web browser without users' consent, Bloomberg reported on Friday.

The agency is investigating whether the cookies allowed it to aim advertising at users of Apple's Safari browser, and also whether Google violated other rules involving consumers' consent, Bloomberg cited sources as saying.

The FTC and Google did not immediately respond to a request for comment late Friday.

Bloomberg reported on Thursday that the FTC had asked Apple for more information regarding how it incorporates Google's search function into its products. The Internet search giant has been accused of using its clout in the search market to shut out rivals, like travel search, by putting them low in search results.

In January, regulators expanded a probe to include Google+, the search giant's new social networking tool, which launched last June and offers many of the capabilities available on Twitter and on Facebook.

(AP) ? Every bump and swat threw yet another chill into a California team that had never seen anything like it.

Must have made the other teams in South Florida's bracket shudder just a bit, too.

The Bulls introduced the Big East's nastiest defense to the NCAA tournament Wednesday night, allowing only 13 points in the first half of a 65-54 victory over a California team that went long stretches without a single point.

Ugly, ugly, ugly. Just the way South Florida likes it.

"We get mad when people score, no matter what kind of bucket it is," said Victor Rudd, who had 15 points. "And that's what makes us have people scoring in the 50s, 40s. We don't like it when people score at all, not even on a free throw.

"So we get mad at each other, and that's how we play great defense."

South Florida (21-13) will play No. 5 seed Temple in Nashville on Friday, a matchup of teams known for gritty defense. Few have been better than this one for the first 20 minutes on the NCAA stage.

The Bulls swarmed 'em, bumped 'em and swatted their shots away ? those that weren't air balls, that is.

California (24-10) didn't score over the last 8:55 of the first half, missing 10 shots and turning it over twice while South Florida pulled ahead 36-13.

"We just didn't have any energy," California guard Allen Crabbe said.

Yep, the Bulls stole that away, too.

Guard Jorge Gutierrez, the Pac-12 player of the year, was held to 10 points on 4-of-10 shooting. California managed only five field goals in the first half, when three of their points came off free throws.

"I didn't imagine that happening," California coach Mike Montgomery said. "We dug ourselves a huge hole in the first half, and that's probably as bad as I've seen us play. We weren't doing much of anything."

It wasn't all defense that got it done for South Florida. Freshman point guard Anthony Collins, a thin-built player with a youthful face that reminds coach Stan Heath of a 12-year-old kid, played like a star in his first NCAA tournament game, scoring 12 points.

"We play great defense," Collins said. "So when we just take our time and get great shots on offense, I think we can beat anybody."

The Golden Bears won't soon forget the way they got worked over. They must have felt as if there were six Bulls on the floor at times playing defense.

No, only five. The refs counted.

The Bulls set a Big East record by giving up only 56.9 points per game this season. Their problem: They score about as many points as they give up. South Florida didn't have a player average in double figures for the season.

Realizing he didn't have many scoring options, Heath instituted the defense-first, defense-last philosophy that got them to their first NCAA tournament appearance in 20 years and, now, their first win. The Bulls came in 0-2 in the tournament.

Other teams exult when one of their players hits a big basket. The Bulls cheer from the bench as the other team passes the ball around helplessly and hopelessly.

They were cheering their defense from the opening tip.

The first time down the court, Gutierrez forced a running shot that was too hard, a taste of the misery ahead. California missed its first five shots and eight of its first nine, helping South Florida pull ahead 15-3.

Collins made a driving layup, a floater, a 15-foot pull-up jumper and a layup off his steal during the opening run, getting South Florida's unpredictable offense moving.

The Golden Bears readily acknowledged that they hadn't played anything quite like the Bulls' defense. With four players averaging in double figures, their best chance was to spread the ball around and be patient.

They ran out of patience real fast, prompting Montgomery to call a timeout to get his team settled down. Instead, things quickly got worse.

A lot worse.

Gutierrez hit a fade-away 15-foot jumper with 8:56 left in the first half. The Golden Bears wouldn't score again before halftime, with South Florida pulling off a 14-0 run. It ended with a telling moment: California guard Justin Cobbs dribbling toward the basket and failing to even attempt a shot before the buzzer sounded.

Totally discombobulated.

The Golden Bears shuffled toward the locker room with blanks expressions. Their 13 points matched the seventh-fewest in an opening half since the NCAA tournament expanded in 1985, according to STATS LLC.

The Bulls pulled ahead 57-25 with 8:49 left, making sure there wouldn't be another big comeback on the same floor where two of them opened the First Four on Tuesday night.

"I really liked for the 30 minutes the way we played," Heath said.

The only question was how low they could keep the sore. California got its 40th point with 2:54 to go, and fouled repeatedly in the final minute, giving itself enough chances to hit the 50-point mark.

Over 30 states participated in 2011 and this year the Rhode Island Library Association is bringing the program to RI libraries around the state. Money Smart Week 2012 will take place April 21-28. She also manages the certificate program in Family Financial Counseling and Planning. Her most recent research and outreach focuses on the impact of personal finance educational programs for changing the financial behavior of consumers.

Ms. Kerbel is an adjunct faculty member and academic advisor in the Department of Human Development and Family Studies at the University of Rhode Island. She also serves as the Director of Outreach at the Center for Personal Financial Education. Over her career as a financial educator, she has managed numerous outreach programs, most recently a workplace financial education project, community-based personal finance workshops for women, and financial literacy trainings for teachers.

Ms. Smith is Sojourner House?s Safe House Coordinator. She has seen the prevalence of financial control as a means of abuse. Sojourner House is a comprehensive domestic violence agency that provides wrap-around services to victims? of intimate partner violence . Financial literacy is an issue that is deeply intertwined with relationship violence and financial health and stability is key to recovering from abuse. Sojourner House offers financial literacy trainings to clients and members of the community that include information on financial fundamentals, financial safety planning while in and after leaving an abusive relationship, rebuilding credit, and other topics as requested by participants.

World News - 100 human corpses found in basement of German ...

To the people who found the room, it looked like a scene from a horror film. Last month, staff at the University of Cologne in Germany discovered a basement room in the institute of anatomy filled with more than 100 human corpses and plastic buckets labeled, ?noses,? ?newborns? and ?shark head,? the Guardian reported. It appeared they had been abandoned for a decade or longer.

A staff member told a German newspaper that the cooling system had broken and that the room smelled putrid.

An investigation is ongoing, the Guardian reported and the corpses of people who had donated their bodies to science are slowly being identified.


As rumors swirled around the university about the macabre findings last month, Professor J?rgen Koebke, 66, the former director of the institute of anatomy, was found dead under a bridge in Cologne. Authorities believe the professor, respected by staff and students, stabbed himself to death.

Green car promotions begin to pay dividends | Eco-Business.com

Despite lingering consumer doubts about the technology and practicality of electric vehicles, the Chinese government and automakers are pushing ahead with the development of green cars.

Buyers of hybrid cars, which run on a combination of batteries and conventional engines, are entitled to a direct central government subsidy of 5,000 yuan ($790) per vehicle, while a rebate of up to 60,000 yuan on the purchase price is offered to buyers of battery-driven cars.

Other than government incentives, auto manufacturers are luring buyers of their alternative cars with free maintenance and a range of personalized services.

Their combined effort to promote greener cars on Chinese roads is beginning to pay off. A survey by the China Association of Automobile Manufacturers showed that 8,159 hybrid and electric cars were sold nationwide in 2011. All together, there are more than 10,000 green cars on China?s roads.

The energy conversion rate of electric vehicles in general is 46 percent higher than in internal combustion engine cars, and they have the potential to reduce carbon dioxide emissions by up to 68 percent, said Raymond Tsang, partner at Bain and Company.

The majority of early converts to green cars are college-educated young professionals in major cities. For instance, Zhao Yu, a 30-year-old office worker at Shanghai International Automobile City, in Jiading, a district of the Shanghai municipality, bought a hybrid car domestically produced by BYD ?to show support for my district?s reputation as the country?s showroom for energy-efficient cars?.

Jiading, home to Shanghai Automotive Industry Corporation (Group), one of China?s largest car manufacturers, considers itself a suitable testing ground for popularizing the use of clean cars.

All the promotions were making Zhao feel embarrassed every time she drove her gas-guzzling, pollution-belching, sinister-looking lump of a sedan to work every day. To repent, she spent 160,000 yuan in April last year to buy BYD?s new hybrid model, the F3DM, to drive to work and show her eco-friendly credentials.

To her surprise, buying the car has brought benefits that make her feel like a pampered child. For a start, she received close to a 40 percent, or 60,000 yuan, rebate from the central and local governments on the purchase price of her hybrid car. What?s more, she was told she could enjoy free battery recharge at stations sprouting in the city, compliments of the Jiading district government.

?I am still getting the hang of owning and driving a hybrid car,? she said. But the many incentives have removed any earlier doubts she had about the economic sense of buying one. ?I feel like I am one of the chosen few,? she said. That feeling, she added, ?makes me feel immensely proud of my decision?.

Zhao?s F3DM can go as far as 150 kilometers in hybrid mode, a range long enough to make the daily round trip from her home to the office and back. ?I never need to worry about running out of juice in the middle of nowhere,? she said.

In electric power mode, the batteries can sustain up to 90 minutes? driving, or 80 kilometers, before the gas engine takes over. ?I only need to recharge the batteries once every day, after I get to work,? Zhao said.

The good thing, Zhou added, is that her car is smooth and quiet. What?s more, it saves her quite a bit on fuel costs, compared to her other car, which she drives only on weekends.

?But the shortage of recharging stations outside Jiading has made it impractical to take my hybrid anywhere other than the office,? she said, sighing. Otherwise, she said, ?I would have sold my old car in a jiffy.?

China?s strategy to develop new energy cars has gained sufficient ground on many fronts. When coal imports began to exceed exports in 2009, the government saw the urgent need to reduce the country?s dependence on fossil fuels and launched a campaign to widen the use of alternative energy sources.

The country also faces the challenge of reducing greenhouse gas emissions in every sector of the economy. Battery performance remains the challenge to the practicality of electric vehicles. Wang said Chinese companies still lag far behind their competitors in the West and Japan in battery technology.

HE'LL DO: Mitt Romney faces a tough sell in the Deep South. With Mississippi and Alabama primaries coming up next Tuesday, there's concern that he's too slick, not really a conservative. In a region where the evangelical vote is important, some are skeptical about his Mormon faith. But if Romney wins the Republican nomination and it's a November choice between him and Democratic President Barack Obama, the former Massachusetts governor may be just good enough for some Southerners. "If push comes to shove and he gets the nomination, I'll go in the voting booth like this and vote for him," says Mississippi retiree David Wilke, holding his nose.

WHEN ADS ATTACK: The Red White and Blue Fund, the super PAC supporting Rick Santorum, is releasing a television ad that swipes at both Romney and Gingrich, casting them as similar to President Barack Obama ? and presses Santorum's overarching message that he's the most conservative candidate in the race. But it also acknowledges that Gingrich is a formidable opponent in the Southern states. Gingrich represented Georgia in Congress for 20 years. And while Santorum could afford to ignore Gingrich in contests in the North and Midwest, Santorum seems to know he can't do the same in Mississippi and Alabama.

DINING FOR DOLLARS: President Barack Obama and first lady Michelle Obama were dining Thursday with three donors to his re-election campaign, but this wasn't the usual high-ticket fundraiser. Donations weren't even required, but the campaign asked for contributions of at least $3 for a chance to win a private meal with the first couple. The Obamas were joined by a nonprofit executive from Nashville, a former social worker from Wauwatosa, Wis., and a retired school administrator from Cambridge, Mass., and their guests for the third "Dinner with Barack," The president's campaign has emphasized small donations from the masses, pointing to it as a sign of his broad appeal.

LONDON (Reuters) - The world's biggest record label says it is trying something a little different as it seeks the elusive "holy grail" for Japanese pop -- global chart success.

A procession of "J-pop" acts touted as the next big thing on the world stage have come and gone, most causing barely a ripple in markets like the United States, Germany and Britain.

Audiences outside Asia just don't "get" the music and lyrics, experts say, although pinning down exactly why has proved more difficult.

Labels' strategy has tended to focus on coaching Japanese acts to sound and appear more Western, notably by encouraging them to sing in English and try genres like hip-hop and R'n'B.

Now Universal Music Group plans to do the opposite as it seeks to launch techno-pop girl band Perfume on to the world stage -- celebrate their "Japan-ness."

"We want to sell the package as they are now," said Kimitaka Kato, managing director of Universal International at the label's Japanese division.

"I won't get them to sing 100 percent in English and not Westernize them at all unless they ask us to," he told Reuters by telephone from Japan. "I think with Perfume it's all about that futuristic Japanese image."

In what is billed as a first for Universal, it has just released Perfume's number one album "JPN" on iTunes in 50 countries.

"FUTURISTIC, ROBOTIC, DOLL-LIKE"

Kato said the trio -- Nocchi, Kashiyuka and Aa-Chan -- may learn English over time, enabling them to express themselves overseas, but for now they would play on the image of "mysterious, futuristic, robotic, doll-type girls, well choreographed with laser beams."

And in a bid to avoid mistakes of the past, they will stick to the style of music they know best.

"We are Japanese, we are Asians, we can't necessarily sing 'R'n'B' or hip-hop," he said. "We should do what we're good at -- what we're good at is pop tunes."

In their 20s, the singers often appear in matching outfits, and YouTube footage features high-tech shows with elaborate lighting, synchronized dancing and giant video screens.

Perfume formed in 2000 and had its breakthrough in 2007 with the hit "Polyrhythm." According to Universal, which signed the band from independent label Tokuma, they have sold 1.3 million albums in Japan to date.

Kato said he had been encouraged by the recent success of "K-pop" acts from South Korea who had made limited inroads in Europe and beyond in recent months.

But he also conceded there was no guarantee that Perfume would find the magic formula to appeal to audiences in the United States and beyond.

Universal has tried before, notably with singer Utada who broke chart records in Japan but failed to match expectations internationally.

That may explain the label's gradual approach with Perfume, starting with promotion inside Asia followed by a small "showcase" tour further afield.

"I think it will work, but if it doesn't, I don't want other Japanese bands having a hard time," Kato explained.

Japan prosecutors charge key figures in Olympus scandal

TOKYO (Reuters) - Tokyo prosecutors on Wednesday charged Olympus Corp and six key figures in the $1.7 billion accounting fraud at the camera and endoscope maker, tightening their case in the investigation of one of Japan's biggest corporate scandals.

Prosecutors charged ex-chairman Tsuyoshi Kikukawa, former executive vice-president Hisashi Mori and former auditor Hideo Yamada with inflating the company's net worth in financial statements for the fiscal years ended March 2007 and 2008, in violation of the Financial Instruments and Exchange Law.

Also charged were former bankers Akio Nakagawa, Nobumasa Yokoo and Taku Hada, prosecutors said in a statement.

The six were arrested in February on suspicion of filing false financial statements to help hide huge investment losses through complex takeover deals at the company. Prosecutors did not charge a seventh person they arrested last month.

"We take these charges very seriously and will continue to strengthen our corporate governance," Olympus said in a statement. "We again express our deep apologies to shareholders, investors, business partners, customers and other related parties for causing trouble."

Prosecutors on Wednesday also rearrested Kikukawa, Mori, Yamada and Nakagawa on suspicion of also submitting false financial statements for the fiscal years ended in March 2009, 2010 and 2011.

In Japan it is common for prosecutors to re-arrest suspects under new but related counts. They must decide within 20 days whether the suspects are to be formally charged over the fresh allegations.

Japan's securities watchdog on Tuesday requested that prosecutors file criminal charges against the individuals involved in the scandal and the company itself.

Under the charges, Olympus executives could face up to 10 years in prison, or a fine of up to 10 million yen (about $125,000), lawyers have said.

Shares of Olympus, which have lost about half of their value since the scandal broke, closed down 1.1 percent at 1,286 yen on Wednesday afternoon, compared with a 0.6 percent decline in the broader market.
